Introduction
Acorns Insurance Services, LLC (“Acorns,” “we,” “us,” or “our”) is a Delaware-domiciled limited liability company conducting business as an insurance producer, licensed in 40 states and the District of Columbia. Its principal address is 5300 California Avenue, Irvine, CA 92617.
Service Marks
Acorns’ name, logo, and all related names, logos, product and service names, designs, and slogans are service marks of Acorns, its affiliates, and/or its licensors. You must not use such marks without the prior written permission of Acorns. All other names, logos, product and service names, designs and slogans on this Website are the trademarks or service marks of their respective owners. The word marks “Acorns Protect”, “Acorns Insurance”, and “Acorns” (in any font size or color) as they may appear alone or in conjunction with the following symbol are service marks of Acorns and/or its affiliates, and may not be copied, duplicated, or used for commercial purposes without express written permission.
Acorns’ Business
Acorns is a licensed life and personal lines insurance producer. Acorns maintains insurance producer licenses in 40 states and the District of Columbia.
Acorns represents insurance companies (not applicants or insureds) in the solicitation and sale of insurance products, but currently is not a Managing General Agent (MGA) for any insurer as that term is defined in state insurance laws. Most of Acorns’ business is generated from retail surplus lines brokers (often called sub-producers) who represent applicants and insured clients. In some transactions, intermediary producers, who may be acting on behalf of the applicant or insured or on behalf of an insurance company, may be involved.
Acorns, or one or more of its affiliates, owns and maintains our website: www.app.acorns.com (the “Website”) and the “Acorns” phone application (the “App”, the relevant portions of each collectively referred to herein as “Acorns Protect”), each a proprietary portal that may be accessed by the verified customers of Acorns and its affiliates, who are then exposed to, or referred to, insurers to apply for insurance through Acorns Protect. Access to and use of Acorns Protect permits consumers to provide certain information about themselves and see Acorns’s insurance partners who may offer certain insurance products to consumers. All transactions for the procurement of insurance take place directly between the consumer and their chosen insurance provider. Access to Acorns Protect is not a grant of binding or underwriting authority or an offer of insurance and is not intended to create an agency relationship between Acorns and any person, but rather is an application of technology to enable the introduction of a variety of insurance providers to a consumer. Authority granted by Acorns, if any, is limited by the terms of this agreement.
Acorns maintains a customer support department which can provide contact information to consumers for insurance providers referenced in Acorns Protect. Please be advised that customer support cannot provide assistance to consumers or other third parties by responding to inquiries and assisting with insurance transactions, as insurance transactions are not done through Acorns Protect.
Acorns does not accept claim notices or service of legal process on behalf of the insurance companies it represents, nor does it adjust claims. When a claim is made, notice should be given to the insurer, or to any retail broker representing the insurer which is responsible for providing the notice to the insurer. Instructions for filing a claim are typically included with the policy. In some cases, the insurance company may be represented by a claim service company. Acorns is not a claim service company.
Any descriptions of insurance products or services by Acorns do not amend, modify, or supplement any insurance policy. Policyholders should consult the actual policy and their insurance agent or broker for details regarding terms, conditions, coverage, and exclusions in the policy, as well as products, services, and programs which may be available. Eligibility for particular products and services is subject to the final determination of underwriting qualifications by the insurer. Not all policies and/or coverages are available in every jurisdiction.
Whether coverage exists or does not exist for any particular claim or loss under any policy depends on the facts and circumstances involved in the claim or loss, the law applicable to the claim, and all applicable policy wording. Any informational statements regarding insurance coverage, either on Acorns Protect or other Acorns material, are for general description purposes only.
The general information contained on Acorns Protect is not an offer to sell insurance. No binder, insurance policy, change, addition, and/or deletion to insurance coverage goes into effect until the policy is issued and premium is paid. Any proposal of insurance Acorns may present will be based upon the information the applicant provides. Information provided on this site does not constitute professional advice. Compensation
Acorns is committed to dealing fairly and with complete integrity with consumers, other insurance producers, and others with whom we work in connection with insurance products and services. To that end, we provide this disclosure regarding Acorns’ sources of its compensation from insurance companies or other relevant parties.
Acorns may receive compensation in the form of flat “lead generation” fees paid by one or more insurance companies, for each consumer Acorns directs to an insurance company’s website, pursuant to an arrangement with the relevant insurance companies. These fees are for the service we perform in referring potential consumers to the insurance company.
Acorns may receive compensation in the form of commissions paid by one or more insurance companies, calculated as a percentage of premiums, pursuant to an arrangement with the relevant insurance companies. These commissions are for the service we perform in placing and servicing insurance policies on the insurance company’s behalf.
Acorns may also be eligible to receive other forms of compensation such as incentive or contingency payments or bonuses and/or supplemental commissions from insurance companies. These may be based on our aggregate historical or current performance with respect to a line of business or customer segment and not specifically related to any particular policy or policyholder.
Other insurance producers who perform service in placing and servicing insurance through Acorns may receive compensation from Acorns in the form of service fees as determined by Acorns’ arrangement with such producer.
Acorns may hold premium or return premium funds temporarily, in which case Acorns may receive interest or investment income on such funds.

Terms of Use
Acceptance of the Terms of Use
These terms of use are entered into by and between you and Acorns. The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of Acorns Protect, including any content, functionality and services offered on or through Acorns Protect.

Acorns Protect is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. By using Acorns Protect, you represent and warrant that you are of legal age to form a binding contract with Acorns and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use Acorns Protect.
Changes to the Terms of Use
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of Acorns Protect thereafter. However, any changes to the dispute resolution provisions set forth under Governing Law and Jurisdiction below will not apply to any disputes for which the parties have actual notice prior to the date the change is posted on Acorns Protect.
Your continued use of Acorns Protect following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
Accessing Acorns Protect and Account Security
We reserve the right to withdraw or amend Acorns Protect, and any service or material we provide on Acorns Protect, in our sole discretion without notice. We will not be liable if for any reason all or any part of Acorns Protect is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Acorns Protect, or the entire Acorns Protect, to users, including registered users.

It is a condition of your use of Acorns Protect that all the information you provide on Acorns Protect is correct, current, and complete. If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security.
We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.
Additional Intellectual Property Rights
In addition to the notice concerning Acorns’ ownership of its service marks and logo above, Acorns Protect and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Acorns, its Affiliates or its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights and laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Acorns Protect, except as follows:

We assume no liability for any action or inaction regarding transmissions, communications, or content provided by any third party. Acorns shall have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

The information presented on or through Acorns Protect is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to Acorns Protect, or by anyone who may be informed of any of its contents.

All statements and/or opinions expressed in these materials, other than the content provided by Acorns, are solely the opinions and the responsibility of the person or entity providing those materials. Acorns welcomes your comments. All comments, suggestions or other information sent by you to Acorns Protect will become Acorns’ property, and you agree that all intellectual property rights therein are transferred to Acorns. Geographic Restrictions
The owner of Acorns Protect is based in the State of California in the United States. We provide Acorns Protect for use only by persons located in the United States. We make no claims that Acorns Protect or any of its content is accessible or appropriate outside of the United States. Access to or use of services provided on Acorns Protect may not be legal by certain persons or in certain countries. If you access Acorns Protect from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
Disclaimer of Warranties
You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or Acorns Protect will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. ACORNS PROTECT, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH ACORNS PROTECT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Indemnification
You agree to defend, indemnify and hold harmless Acorns, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of Acorns Protect, any use of Acorns Protect’s content, services, and products other than as expressly authorized in these Terms of Use or your use of any information obtained from Acorns Protect.
Governing Law and Jurisdiction
All matters relating to Acorns Protect and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).
Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or Acorns Protect shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in the City of Irvine and County of Orange. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Arbitration
At Acorns’ sole discretion, we may require you to submit any disputes arising from the use of Acorns Protect or these Terms of Use, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration as provided in the Program Agreement

Waiver and Severability
No waiver by Acorns of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Acorns to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
Additional Terms and Conditions
Additional terms and conditions may also apply to specific portions, services, or features of Acorns Protect. All such additional terms and conditions are hereby incorporated by this reference into these Terms of Use.
Entire Agreement
These Terms of Use, the Program Agreement, and our Privacy Policy constitute the sole and entire agreement between you and Acorns Insurance Services, LLC and its affiliates with respect to Acorns Protect and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to Acorns Protect.

SUPPLEMENTAL PRIVACY POLICY TERMS
These Supplemental Privacy Policy Terms (“Privacy Policy”) incorporate and supplement the Acorns Master Privacy Policy with respect to information collected through use of Acorns Protect, which is operated by Acorns Insurance Services, LLC (“Acorns”). The purpose of these Supplemental Privacy Policy Terms is to provide the specific disclosures related to the use of Acorns Protect. The Acorns Master Privacy Policy, located at www.acorns.com/privacy, and this Supplemental Privacy Policy both apply to the use of Acorns Protect. In the event that the terms of this Supplemental Privacy Policy and the Acorns Master Privacy Policy conflict, the terms in the Supplemental Privacy Policy will take precedence for personal information used for Acorns Protect.
This Privacy Policy explains how Acorns Protect collects, uses, and discloses your information, as well as the rights and choices you have regarding the use of your information. When you use Acorns Protect, you are agreeing to the collection, use, and sharing practices as described in this Supplemental Privacy Policy and the practices set forth in the Acorns Master Privacy Policy.

In addition to the personal information collected from you pursuant to the terms set forth in the Acorns Master Privacy Policy (www.acorns.com/privacy), Acorns Protect collects personal information from you that is necessary for processing your insurance application. Information Sharing
In addition to the information sharing practices set forth in the Acorns Master Privacy Policy, Acorns Protect may submit your information to third-party insurance companies in order to fulfill your requests for specific products and services. Acorns Protect is not responsible for the privacy and security practices of these companies. By using Acorns Protect, you agree to your personal information being subject to the terms set forth in the third parties’ privacy policies and terms of service.
User Access and Choice

Supplemental information to the California Collection Notice
In addition to the information referenced in the California Collection Notice in the Acorns Master Privacy Policy, we also specifically collect the following categories of personal information to facilitate the Acorns Protect service:
This information is used only to facilitate your requests for specific insurance products from third parties. Once that information has been disclosed to those specific third parties at your request, Acorns Protect does not retain that personal information for any purpose.

Changes to this Supplemental Privacy Policy
We may update this privacy policy to reflect changes to our information practices related to Acorns Protect. If we make any material changes to this Supplemental Privacy Policy, we will notify you by email or by means of a notice on the Acorns Protect website prior to the change becoming effective.
